BagCheck™ Terms & Conditions

Effective Date: August 10, 2025

1. Service Overview

BagCheck™ is a mobile platform that leverages artificial intelligence (“AI”) and image-based analysis to deliver informational assessments regarding the possible authenticity, brand, model, materials, estimated retail value, resale value, and approximate era of luxury handbags.

Users upload images and related information, and the system generates an AI-driven informational conclusion based on visible indicators and proprietary reference data.

All results are non-binding, non-certified, and provided solely for informational and educational purposes. BagCheck does not issue Certificates of Authenticity (“COAs”), professional appraisals, legal opinions, or guarantees of authenticity.

2. Important Disclaimer on AI, Accuracy & Internal Calculations

All outputs produced by BagCheck are derived solely from:

  • User-submitted images and information
  • Artificial intelligence analysis
  • Internal databases and proprietary reference algorithms

You acknowledge and agree that:

  • Accuracy is not guaranteed
  • Results may be incorrect, incomplete, inconclusive, outdated, or misleading
  • AI technology has inherent limitations and may produce inaccurate conclusions

All internal calculations, including but not limited to:

  • Estimated retail value
  • Estimated resale value
  • Historical pricing
  • Market comparisons
  • Model identification
  • Material identification
  • Approximate production year or era

Price projections are estimates only and may contain errors.

BagCheck does not guarantee:

  • Authenticity
  • Financial accuracy
  • Market value
  • Resale value
  • Investment potential
  • Profitability
  • Future pricing

BagCheck does not replace professional authentication services, brand verification, certified appraisers, insurance appraisals, legal advice, financial advice, Entrupy hardware authentication systems, or any other professional evaluation.

All use of the application and reliance upon its results is entirely at the user’s own risk.

3. Camera & Photo Permissions

BagCheck requires access to your device’s camera and/or photo library to allow you to capture or upload images for AI analysis.

Camera, photo library, and file access are requested only with your permission. You may revoke these permissions at any time through your device settings.

BagCheck accesses only the photographs and files that you choose to upload or capture and does not access your camera or photo library without your explicit authorization.

4. User Responsibilities

By using BagCheck, you represent and warrant that you:

  • Are at least eighteen (18) years old.
  • Will upload only truthful, accurate, and unaltered images.
  • Own or have all necessary rights and permissions to upload any photographs, images, or other content submitted through the application.
  • Will not upload stolen, fraudulent, copyrighted, illegal, misleading, or infringing material.
  • Understand that all BagCheck results are informational only.
  • Accept sole responsibility for any purchasing, selling, trading, insurance, appraisal, investment, or valuation decisions made using the application.

5. User Content License

By uploading photographs or other content to BagCheck, you grant BagCheck LLC a worldwide, non-exclusive, royalty-free license to store, reproduce, process, analyze, display, and use such content solely for the purpose of operating, maintaining, securing, and improving the Services.

If BagCheck uses uploaded content to improve AI performance, such use will occur only as described in our Privacy Policy and in accordance with applicable law.

6. Limitation of Liability

To the fullest extent permitted by applicable law, BagCheck LLC, its owners, officers, directors, employees, contractors, licensors, affiliates, successors, and agents shall not be liable for any:

  • Incorrect authenticity assessments
  • Errors in brand, model, or year identification
  • Incorrect AI-generated conclusions
  • Inaccurate retail, resale, or market valuations
  • Financial losses
  • Lost profits
  • Lost business opportunities
  • Purchase or sale decisions
  • Insurance disputes
  • Third-party authentication disagreements
  • Technical failures
  • Internet outages
  • Wi-Fi interruptions
  • Software bugs
  • System downtime
  • API failures
  • User-submitted inaccuracies
  • Data loss
  • Marketplace disputes
  • Indirect, incidental, consequential, punitive, or special damages of any kind

Your use of BagCheck is entirely at your own risk.

7. Third-Party Resellers & External Platforms

BagCheck may display links or information from third-party services including, but not limited to:

  • Rebag
  • Fashionphile
  • Vestiaire Collective
  • The RealReal
  • Sotheby’s

You acknowledge that:

  • BagCheck does not sell products.
  • BagCheck does not verify third-party listings.
  • BagCheck does not inspect inventory.
  • BagCheck does not guarantee pricing, authenticity, availability, condition, shipping, returns, or refunds.
  • Any transaction occurs solely between you and the third-party platform.
  • BagCheck assumes no responsibility for losses arising from transactions with third-party services.

8. Location Services

Location access is optional and is used solely to display nearby luxury resale services and related features.

You may disable location permissions at any time through your device settings.

BagCheck does not sell your precise location data.

9. Accounts & Privacy

Certain features require account registration.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

Information regarding the collection, storage, processing, camera permissions, uploaded images, analytics, location data, and personal information is governed by our Privacy Policy.

10. Intellectual Property

All software, source code, algorithms, AI systems, databases, trademarks, branding, graphics, interfaces, designs, content, and proprietary technology remain the exclusive property of BagCheck LLC.

No portion of the application may be copied, reproduced, reverse engineered, modified, distributed, sold, licensed, or commercially exploited without prior written permission.

11. Indemnification

You agree to defend, indemnify, and hold harmless BagCheck LLC, its owners, officers, employees, affiliates, contractors, and licensors from any claims, damages, liabilities, losses, costs, or expenses arising out of:

  • Your use of the Services
  • Your uploaded content
  • Your violation of these Terms
  • Your infringement of another person’s rights
  • Your financial or purchasing decisions
  • Any dispute involving third-party marketplaces

12. No Warranties

BagCheck is provided strictly on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, BagCheck disclaims all warranties, express or implied, including but not limited to:

  • Accuracy
  • Reliability
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Continuous availability
  • Error-free operation
  • Market valuation reliability
  • Authentication accuracy

13. Subscription & Payment Terms

BagCheck offers:

  • One (1) complimentary scan upon account registration
  • Monthly Subscription: $9.99 USD
  • Annual Subscription: $99.99 USD

All subscription purchases are processed exclusively through Apple’s App Store using your Apple ID.

Subscriptions:

  • Automatically renew unless canceled at least twenty-four (24) hours before the end of the current billing period.
  • May be managed or canceled through your Apple ID Account Settings.
  • Are subject to Apple’s billing and refund policies.
  • Are non-refundable except where required by law or permitted under Apple’s policies.
  • May have pricing adjusted for future renewal periods.

Subscription benefits terminate upon cancellation or expiration.

BagCheck is not responsible for billing errors, payment processing issues, subscription management errors, or refund decisions made by Apple.

14. Apple App Store Terms

If you downloaded BagCheck through Apple’s App Store:

  • Apple Inc. is not responsible for the application, its content, maintenance, support, or warranty obligations.
  • Apple has no responsibility for addressing claims relating to the application, including product liability, legal compliance, intellectual property claims, or consumer protection claims.
  • Any disputes concerning BagCheck are solely between you and BagCheck LLC.

15. Termination

BagCheck reserves the right to suspend or terminate accounts for:

  • Fraud
  • Abuse
  • Misuse
  • Unauthorized access
  • Violation of these Terms
  • Illegal activity

Termination does not automatically entitle you to any refund of subscription fees previously paid.

16. Force Majeure

BagCheck shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including natural disasters, cyberattacks, internet failures, power outages, labor disputes, governmental actions, pandemics, third-party service interruptions, or other force majeure events.

17. Modifications

BagCheck may update these Terms at any time.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law & Arbitration

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively through binding arbitration in New York County, New York.

You waive any right to participate in a class action lawsuit, class arbitration, or jury trial to the fullest extent permitted by law.

  • BagCheck™ is a trademark of BagCheck LLC.
  • BagCheck LLC is a registered limited liability company organized under the laws of the State of New York.
