BagCheck LLC (“BagCheck,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, store, process, and disclose your information when you use the BagCheck mobile application (“App”). By using the App, you consent to the practices described in this Policy.

1. Information We Collect

a. Uploaded Content

We collect the images and related metadata you upload for authentication and bag analysis. These images are processed using AI technology to generate informational results.

  • Images may be temporarily stored for processing, quality control, fraud prevention, AI training (anonymized), and system optimization.
  • We do not guarantee permanent deletion timelines due to system backups, legal requirements, or technical limitations.

b. Device & Usage Information

We may automatically collect:

  • Device type
  • Operating system
  • App version
  • IP address
  • Usage behavior and session data

Collected via services such as Firebase Analytics solely for diagnostics, performance monitoring, and service improvements.

c. Account Information

If you create an account, we may collect:

  • Name
  • Email address
  • Username and profile details

Users are responsible for keeping information accurate.

d. Subscription & Payment Information

All payments are processed entirely by Apple App Store.

BagCheck only receives:

  • Subscription status
  • Plan type
  • Renewal status
  • Transaction identifiers

We never store payment credentials.

e. Location Data

With user permission, we collect approximate location only for nearby store/map functionality.

Location access is optional and may be disabled at any time.

We do not sell, permanently store, or monetize precise location data.

2. How We Use Your Information

We use collected information solely to:

  • Perform AI-based image authentication and analysis
  • Display market comparison estimates and reseller availability
  • Improve AI models and system performance
  • Operate user accounts and subscriptions
  • Provide customer support
  • Detect fraud or abuse
  • Comply with legal obligations
  • Send service updates (with consent)

All outputs are informational only and not guaranteed to be accurate.

3. Data Accuracy Disclaimer

All outputs depend on:

  • User-submitted images
  • Machine-learning interpretation
  • Internal reference databases
  • Third-party reseller API data

We do not guarantee accuracy, completeness, availability, or real-time validity of:

  • Authentication results
  • Pricing estimates
  • Market comparisons
  • Availability, stock status, or resale projections

Users assume full responsibility for any decisions made using app data.

4. Data Retention

  • Uploaded images may be stored temporarily or longer for:
    • AI improvement
    • System audits
    • Legal compliance
    • Security monitoring
  • Account, analytics, and usage data may be retained as long as reasonably necessary for operations.
  • Subscription records are retained for:
    • Customer support
    • Billing verification
    • Compliance with payment regulations

Deletion requests are honored where legally and technically feasible, but complete removal from backups cannot be guaranteed.

5. Third-Party APIs, Data Sharing & Reseller Integrations

BagCheck integrates with the APIs of trusted third-party resale platforms to display:

  • Estimated market pricing
  • Comparable live or recent listings
  • Retailer availability
  • Buying destinations

These platforms may include (but are not limited to):

Rebag, Fashionphile, Vestiaire Collective, Sotheby’s, and similar marketplaces.

Important API Disclosures

  • All pricing, availability, and product data retrieved via APIs is:
    • Provided “as is”
    • Controlled entirely by the third-party platform
  • BagCheck does not guarantee:
    • Accuracy of API data
    • Real-time freshness
    • Continued availability of any listing or price
  • BagCheck does not control external API uptime, errors, omissions, delays, or changes

Data Sharing Limits

We do not sell personal data.

We may share limited data only with:

  • Analytics services (e.g., Firebase)
  • Cloud infrastructure providers
  • Apple App Store (billing)
  • Reseller APIs as technically required to fetch public listing estimates

All third-party services operate under their own privacy policies.

BagCheck is not responsible for third-party data handling practices.

6. Security Measures

We use commercially reasonable safeguards to protect user data. However:

  • No electronic system is 100% secure
  • Users acknowledge and accept inherent security risks
  • BagCheck is not liable for breaches beyond reasonable preventive measures

7. Children’s Privacy

BagCheck is not intended for users under 18 years of age. We do not knowingly collect data from minors.

8. Your Rights & Data Control

Users may:

  • Request access to personal data
  • Request account deletion
  • Request image deletion (subject to technical/legal limits)
  • Manage subscriptions through Apple

BagCheck:

  • Is not responsible for financial loss, depreciation, missed profits, buying/selling outcomes, or marketplace disputes
  • Is not liable for decisions made based on estimated pricing, comparisons, or third-party listing data

All financial decisions are made at the user’s sole risk.

10. Data Processing & AI Usage Consent

By using the App, you expressly consent to:

  • Automated AI processing
  • Image recognition and interpretation
  • Algorithmic data modeling
  • Anonymized machine-learning improvement
  • Third-party API data retrieval

11. Changes to This Privacy Policy

We may revise this Policy at any time. Updated versions will be posted inside the App. Continued use constitutes acceptance.

12. Governing Law

This Privacy Policy is governed by the laws of the State of New York, United States.
