BagCheck™ Terms & Conditions

1. Service Overview

BagCheck™ is a mobile platform that uses artificial intelligence (“AI”) and image-based analysis to provide informational assessments only regarding the possible authenticity, brand, model, materials, and approximate era of luxury handbags.

Users upload images and related information, and the system produces an AI-driven informational conclusion based on visible indicators and reference data.

All results are non-binding, non-certified, and for educational and guidance purposes only. BagCheck does not issue formal Certificates of Authenticity (“COAs”).

2. Important Disclaimer on AI, Accuracy & Internal Calculations

All outputs produced by BagCheck are derived solely from:

  • User-submitted images and information
  • AI interpretation
  • Internal databases and reference algorithms

You acknowledge and agree that:

  • Accuracy is not guaranteed
  • Results may be incorrect, incomplete, inconclusive, outdated, or misleading
  • All internal calculations, including but not limited to:
    • Estimated retail value
    • Market comparisons
    • Historical pricing
    • Resale projections
    • Model-year estimations
      are estimates only and may contain errors
  • BagCheck does not guarantee:
    • Authenticity
    • Financial accuracy
    • Market value
    • Resale value
    • Profit potential
  • BagCheck does not replace professional third-party authentication, brand verification, appraisal, or Entrupy-style hardware systems

Use of the app and reliance on any output is entirely at the user’s own risk.

3. User Responsibilities

Users agree that they:

  • Will upload only clear, unaltered, truthful images
  • Will not upload stolen, copyrighted, fraudulent, or misleading content
  • Are at least 18 years of age
  • Understand that all app results are informational only
  • Are solely responsible for any purchasing, selling, or valuation decisions

4. Limitation of Liability

To the fullest extent permitted by law, BagCheck LLC, its owners, officers, employees, contractors, and affiliates shall not be liable for any:

  • Incorrect authenticity assessments
  • Errors in brand, model, or year detection
  • Inaccurate pricing, resale, or valuation estimates
  • Financial losses of any kind
  • Purchase, sale, or investment decisions
  • Lost profits or missed opportunities
  • Technical failures, outages, WiFi issues, or system delays
  • User reliance on app data
  • External marketplace disputes
  • API inaccuracies or downtime
  • Data inaccuracies caused by user submissions

5. Third-Party Resellers & External Platforms

BagCheck may link to or display data from third-party resale platforms including, but not limited to:

Rebag, Fashionphile, Vestiaire Collective, The RealReal, Sotheby’s.

You acknowledge that:

  • BagCheck does not sell products
  • BagCheck does not verify third-party listings
  • BagCheck is not responsible for authenticity, condition, refunds, shipping, returns, disputes, pricing, or losses related to third-party sellers
  • All transactions occur solely between the user and the external platform

6. Location & Map Features

  • Location access is optional and used only to display nearby resale services
  • Users may disable access at any time
  • BagCheck does not sell, permanently store, or distribute precise location data

7. Accounts & Privacy

  • Account creation may be required for certain features
  • Users are responsible for safeguarding login credentials
  • Data handling is governed by our Privacy Policy

8. Intellectual Property

All trademarks, branding, software, algorithms, UI/UX design, and proprietary technology remain the exclusive property of BagCheck LLC.

No copying, reverse engineering, resale, or commercial use is permitted without written consent.

9. Indemnification

Users agree to defend, indemnify, and hold harmless BagCheck LLC from all claims arising from:

  • App usage
  • Uploaded content
  • Financial decisions
  • Violations of these Terms
  • External marketplace disputes

10. No Warranties

BagCheck is provided “AS IS” and “AS AVAILABLE.”

We make no warranties, express or implied, including:

  • Accuracy
  • Merchantability
  • Fitness for a particular purpose
  • Availability
  • Market valuation reliability

11. Modifications

We may update these Terms at any time. Continued use constitutes acceptance.

12. Subscription & Payment Terms

  • One (1) complimentary scan upon account registration
  • Monthly Subscription: $9.99 USD
  • Annual Subscription: $99.99 USD

Subscriptions:

  • Are processed solely through Apple
  • Auto-renew unless canceled 24 hours prior
  • Are non-refundable for unused time
  • Pricing may change at any time
  • BagCheck is not responsible for Apple billing errors

13. Termination

Accounts may be suspended or terminated for:

  • Misuse
  • Fraud
  • System abuse
  • Violations of these Terms

14. Governing Law & Arbitration

These Terms are governed by the laws of New York, USA.

All disputes shall be resolved through binding arbitration in New York County.

Users waive jury trial and class action rights.

15. Trademark & Legal Status

  • BagCheck™ is a pending USPTO trademark
  • BagCheck LLC is a registered U.S. LLC
